Faith's Law (6.28.23) - Faith’s Law is named after prevention advocate and child sexual abuse survivor Faith Colson, who graduated from an Illinois high school in the early 2000s. Faith’s Law was passed by the Illinois General Assembly as two separate pieces of legislation. The first legislation established the definition of sexual misconduct within the School Code and outlined the requirements for schools to develop and post employee code of professional conduct policies. The second legislation adds employment history reviews as part of the hiring and vetting process for schools and school contractors, requires notices to be provided to parents/guardians and the applicable student when there’s an alleged act of sexual misconduct, and makes other changes to the process schools must follow when handling allegations of sexual misconduct.

Resource Guide:

Faith’s Law requires schools to notify parents/guardians of the availability of the Sexual Abuse Response and Prevention Resource Guide published by the Illinois State Board of Education June 12, 2023.

Expectations for Teachers and Staff:

Laboratory Schools teachers, staff, and volunteers must abide by the Faith’s Law Expectations for Teachers and Staff and maintain high standards and professional and appropriate relationships with students, parent/guardians, staff members and others. These Expectations are included in the Faculty Associate Handbook at Appendix F.

Sexual Misconduct Allegation Notification Requirements:

Effective July 1, 2023, if an allegation of sexual misconduct regarding an enrolled student is received by the Office of Equal Opportunity and Access and/or the Laboratory Schools, notice will be provided to students and parents regarding the alleged misconduct. This document describes the notice and timing requirements for students and parents.

Employment History Review Requirements:

Effective July 1, 2023, Faith’s Law requires that Illinois State University must engage in a new process called an Employment History Review (“Faith’s Law EHR”) prior to hiring a University employee to work in a role that involve the possibility of direct contact with children or students in Laboratory Schools grounds and buildings. Direct contact with children or students means the possibility of care, supervision, guidance, or control of children or students or routine interaction with children or students.

The Faith’s Law EHR process will be implemented in addition to the current Fingerprint Criminal History Record Check requirements that impacts University employees and School Contractor employees. The Faith’s Law Employment History Review Summary document provides a brief overview of these requirements.
